This website (https://ywggrade.com/) is operated by York under the registered business name Chubbycat Tech Services, a sole proprietorship based in Winnipeg, Manitoba, Canada ("we", "us"). This page explains what information we collect and how it's used, and the terms for using the website grader.

Websites you grade

When you grade a website, we store the address, the score and the findings for up to 12 months so repeat checks are fast and we can improve the tool. We send the address to Google PageSpeed Insights to measure speed. We do not store the page's content.

To prevent abuse, we keep a one-way hashed version of your IP address for one hour to limit how many checks one connection can run, and we limit how many times one website can be checked and how often reports are emailed.

Website owners can ask us not to grade their website. See For website owners below.

Information you give us

When you unlock a full report or send a message, we collect your name, business name, type of business, email address, and optionally your phone number, website and message. We use this to email your report, reply to you, and understand which kinds of businesses use the tool.

We only send you marketing emails (tips and offers) if you tick the separate box. Every marketing email includes a way to unsubscribe, and you can withdraw consent at any time by replying or emailing hello@ywggrade.com. We do not sell or rent your information or share it with others for their marketing.

Analytics and cookies

We use Google Analytics 4 to understand how visitors find and use the site, such as pages viewed, approximate location, device type and whether a grade was completed. We do not send your name, email, phone or business name to Google Analytics, and we don't use advertising pixels. You can opt out with the Google Analytics opt-out add-on or by blocking cookies.

Fonts and icons load from Google Fonts and cdnjs, which receive standard connection information such as your IP address.

Retention

Grading results are kept for up to 12 months. Contact details are kept while we're in touch and, if you become a client, for as long as needed for our working relationship and business and tax records.

Your rights

Under PIPEDA you can ask to see the personal information we hold about you, correct it, or ask us to delete information we no longer need. Contact us using the details below.

Terms of use

By using the grader or this website you agree to these terms. If you don't agree, please don't use the grader.

What the results are, and what they are not

• A grade is an automated technical check of a website's public homepage at one point in time, scored against the criteria published on How We Grade. Websites change, and automated checks can be wrong or incomplete.
• A grade is not an assessment of any business's skills, service quality, reputation, honesty or results, and it is not our opinion of, or a recommendation about, any business.
• Results and suggestions are general information, not professional, legal or financial advice, and do not guarantee any search ranking, traffic, enquiries or other result.

Acceptable use

You may grade any publicly available website for your own information, including a competitor's to compare with your own. You agree not to:

• publish, send or share results to disparage, harass or mislead others about a business or person;
• present a result as the opinion, rating, review or endorsement of YWG Grade or Chubbycat Tech Services about any business;
• enter an email address that isn't yours, or use the grader to send emails to other people;
• overload websites, scrape our results, or run checks automatically or in bulk.

You are responsible for how you use and share results. If you breach these terms, you agree to be responsible for any claims, losses and reasonable costs that result from your breach, to the extent permitted by law. We may limit or block any use that looks automated, abusive or in breach of these terms, and we may limit how often reports are emailed.

For website owners

If you own a website and don't want it graded, add these lines to your robots.txt file, or email hello@ywggrade.com from an address at your domain and we'll exclude it, including any results we've already stored:

If you believe a result for your website is wrong, tell us and we'll review it by hand and correct any error in the tool.

No warranty and limits on liability

• The grader is free and provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law.
• To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for lost profits, revenue, data or business opportunities, arising from use of the grader, this website or reliance on any result.
• Our total liability for any claim relating to the free grader or this website is limited to CAD $100. For paid services, our total liability is limited to the amount you paid for the service concerned, and the written quote and checklist for that job set out what's included.
• Nothing in these terms limits any liability that cannot be limited under applicable law.

Other terms

• Website names, logos and trademarks that appear in results belong to their owners. Grading a website does not mean we have any relationship with, or endorsement from, its owner.
• We may update these terms. The date at the top of this page shows the latest version, and continued use means you accept the updated terms.
• These terms are governed by the laws of Manitoba and the federal laws of Canada that apply there, and any dispute will be handled by the courts of Manitoba.
